Quicquid Plantatur Solo, Solo Cedit

Meaning: whatever is affixed to the soil belongs to the soil

It means whatever is natural to the soil, or planted there either for ornament or use, which is intended to be permanent, goes with the soil; the owner of the soil is the owner of everything planted in it.

Why it is important?

1. In the field of landlord and tenant, it determine whether a chattel has been attached to the land or to the building to become a landlord’s fixture. If there is no specific clause in the agreement, it will depend on the purpose of the annexation. The character of the chattel and the method of its attachment to the land or buildings are matters to be taken into account in ascertaining that purpose.

2. In the field of builders and contractors, once materials are fixed as part of the permanent works, the maxim quicquid plantatur solo, solo cedit applies. The property in fixed materials passes to the owner of the land. A contractor has no lien on fixed materials and can only sue the employer for sums due under the contract.
